Welcome to the DTF Transfers Now website, owned and operated by DTF Transfers Now. Throughout the site, the terms "we," "us," and "our" refer to DTF Transfers Now. By accessing our website and using our services, you agree to comply with and be bound by the following terms and conditions, along with any other policies referenced herein.

By using this site and/or placing an order with DTF Transfers Now or its affiliated sites, you acknowledge that you have read, understood, and agree to be legally bound by this User Agreement and all incorporated policies. You agree to use this site solely in accordance with this User Agreement.

  • User Responsibility and Indemnification
    • As a printing service provider, we operate solely as facilitators for printing designs provided by our users. You bear full responsibility for the content and legality of the designs you submit. By using our services, you agree to indemnify and hold us harmless from any legal actions or consequences that may arise from the use or distribution of these designs.

Intellectual property rights

DTF Transfers Now takes seriously the intellectual property rights of you and others. By accessing or using the Sites, you agree to be bound by DTF Transfers Now's Intellectual Property Policy, which is incorporated by reference. You further agree to abide by any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of the Sites.

If you plan to resell the products you create with DTF Transfers Now products, you agree that you have full intellectual property rights and your resale is legal and authorized. You agree to indemnify DTF Transfers Now for the production of your designs for the custom products you are creating.

You agree not to use DTF Transfers Now or its Sites to create any material that is unlawful, harmful, hateful, abusive, tortious, harassing, threatening, libelous, defamatory, obscene, vulgar, invasive of another's privacy, or racially, ethnically, or otherwise objectionable, or that infringes on any trademark, patent, copyright, trade secret, or other proprietary right of any third party. Further, DTF Transfers Now, at its sole discretion, retains the right to reject any order that it considers unlawful, harmful, hateful, abusive, libelous, defamatory, obscene, profane (according to FCC standards), and/or any order that portrays irresponsible use of alcohol or other substances, advocating persecution based on any protected category (including but not limited to age, race, gender, religion, disability, or national origin), containing sexually explicit content, or is otherwise inappropriate for DTF Transfers Now's production. If DTF Transfers Now rejects any such order, and it is resubmitted, DTF Transfers Now reserves the right to ban the User and/or IP address(es) submitting such order(s).

  • Ownership of Content
    • All content provided on the DTF Transfers Now website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of DTF Transfers Now or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of DTF Transfers Now and protected by international copyright laws.
  • Trademarks
    • DTF Transfers Now's trademarks and trade dress may not be used in connection with any product or service that is not DTF Transfers Now, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits DTF Transfers Now. All other trademarks not owned by DTF Transfers Now that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by DTF Transfers Now.
  • License and Site Access
    • DTF Transfers Now grants you a limited license to access and make personal use of this site. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. By submitting such content or materials, you grant DTF Transfers Now a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt, publish, translate, distribute, and display such content or materials in any form, media, or technology now known or hereafter developed.

Governing laws

This User Agreement, along with any claims arising from it, will be governed exclusively by the laws of the Commonwealth of Florida, without consideration of conflict of law or choice of law principles.

Dispute resolution

Any disputes arising from or relating to your use of the DTF Transfers Now site, this User Agreement, and/or your relationship or dealings with DTF Transfers Now shall be resolved solely and exclusively in a court of competent jurisdiction in Miami Dade County, Florida, or through arbitration in the Commonwealth of Florida. Both parties submit to the jurisdiction of these courts and waive any defense of inconvenient forum. Disputes will be resolved on an individual basis only, and not as part of any class action or representative proceeding. You and DTF Transfers Now also waive the right to a jury trial for any such disputes. If arbitration is chosen, it will be administered by [Arbitration Association] under its rules, with the award being enforceable in any court with jurisdiction.

  • Informal Resolution
    • We believe in resolving disputes amicably and efficiently. We will make every effort to address and resolve your concerns promptly and effectively.
  • No Class Actions
    • You agree to resolve any disputes with DTF Transfers Now on an individual basis. Any claims you bring against DTF Transfers Now shall be resolved in arbitration only, and you will not bring or participate in any class action or other class proceeding against DTF Transfers Now. THE PARTIES AGREE THAT AS TO ALL DISPUTES, EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN HER, HIS, OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  • Waiver of Jury Trial
    • You and DTF Transfers Now both waive the right to a trial by jury for any disputes arising out of or related to this User Agreement.

Acceptable Use

  • Acceptable Use: We encourage our customers to engage in responsible and effective activities when using our services. The following are examples of acceptable use:
    • Promoting our products and services through personal websites, blogs, social media platforms, email newsletters, and targeted advertising.
    • Creating engaging and original content that educates and informs potential customers about the benefits and features of our products and services.
    • Sharing personal experiences and testimonials related to our products and services.
    • Providing honest and accurate information about our products and services, including their features, pricing, and terms.
  • Unacceptable Use: The following activities are strictly prohibited and constitute unacceptable use of our services:
    • Posting or sharing coupon or deal websites, or any sites primarily focused on providing discounts, deals, or coupons.
    • Creating and distributing unauthorized coupon codes or discounts associated with our products and services.
    • Misleading or deceiving potential customers by providing false or inaccurate information about our products and services.
    • Engaging in any form of spamming, including unsolicited emails, comments, or messages to promote our products and services.
    • Utilizing any illegal or unethical marketing tactics, such as trademark infringement, false advertising, or any other activities that could harm our brand reputation.

By using our services, you acknowledge and agree to adhere to these acceptable use guidelines. We reserve the right to investigate any violations and take appropriate action, including but not limited to withholding or reversing benefits, suspending or terminating your account, and pursuing legal remedies if necessary.

Miscellaneous

Should any clause within this User Agreement be deemed illegal or unenforceable by a court of competent jurisdiction and cannot be modified to render it enforceable, said provision shall be deemed null and void, without affecting the validity of the remaining terms herein. Nevertheless, if any such provision deemed invalid, illegal, or unenforceable can be rectified through modification to render it valid, legal, or enforceable, the party benefiting from said provision may make necessary adjustments to achieve such validity, legality, or enforceability.

The headings and captions provided within this User Agreement are for convenience purposes only and do not influence the interpretation or construction of this agreement.

In the event that DTF Transfers Now chooses to waive or refrain from enforcing any rights under this User Agreement on one occasion, it does not imply a waiver of those rights for any future instances.
